Terms of Service

Nixlab offers services across several tiers, and these Terms apply differently depending on which you engage:

• Launch, a self-serve monthly subscription purchased directly through this website. These Terms are the complete and binding agreement for Launch; there is no separate contract.
• Maintain, Grow, and Scale retainers, recurring monthly services. These Terms govern retainer billing, cancellation, and service scope (Section 4).
• Starter and Business builds, custom, project-based engagements. These are governed primarily by a separate, signed Service Agreement provided to you at the proposal stage, which sets out project-specific terms such as deposit schedule, payment milestones, revision rounds, delivery timeline, and IP transfer. These Terms apply as a backstop to anything that signed agreement does not address, including confidentiality, general liability, and governing law (Section 6).

What's included

Launch is billed at RM497/month or RM4,771/year (paid annually), with no setup cost. It includes a self-serve onboarding questionnaire, up to 5 template-based pages, a lead capture form, WhatsApp CTA, mobile testing across 3 screen sizes, basic SEO, Google Analytics, hosting and SSL, and one free 1-year domain registration. The site is targeted to go live within 7 business days of you submitting your questionnaire and assets (1 logo, 5 images, business name, industry, and business context).

Launch does not include a discovery call, custom design, blog/CMS functionality, or copywriting beyond the context you provide.

Domain registration and renewal

Your first year of domain registration is free and included in your subscription. Domain renewal from the second year onward is billed separately from your subscription fee, at the prevailing rate charged by the domain registry for your chosen domain extension. This rate varies by extension (e.g. .com, .my, .co) and is not fixed by Nixlab. You will be shown the available domain options and their indicative pricing during onboarding, before you commit to a domain, and Nixlab will confirm the exact renewal amount before it is charged each year.

Billing and payment

Launch is billed as a recurring subscription through Stripe. By subscribing, you authorize Nixlab to charge your payment method on a recurring basis (monthly or annually, depending on the plan you select) until you cancel. Subscriptions renew automatically at the end of each billing period.

All charges are non-refundable, except as provided under the 7-Day Delivery Guarantee below. Once a billing period has been charged, no refund will be issued for that period, including if you cancel partway through it. You will retain access through the end of the period you've already paid for.

There is no cancellation fee, you may cancel at any time. Nixlab may change subscription pricing with at least 30 days' notice to active subscribers; continued use after a price change takes effect constitutes acceptance of the new price.

To cancel, reply to your confirmation email or email inquiry@nixlab.my. We will process your cancellation within 3-5 business days.

7-Day Delivery Guarantee

If your site is not built and ready for your review within 7 business days of you submitting a complete questionnaire and all required assets (1 logo, 5 images, business name, industry, and business context), your first month's subscription fee will be refunded in full. The 7-day period is measured from the date of complete submission, not from your checkout date. This guarantee does not apply if delivery is delayed by incomplete or missing information on your end, or by delays in your own review or approval process.

30-day submission deadline

You must complete and submit your onboarding questionnaire, including all required assets, within 30 days of your purchase date. If you have not done so by the 30-day mark, your subscription is void. For monthly subscribers, your payment is non-refundable. For annual subscribers, you forfeit an amount equivalent to one month's subscription fee (RM497); the remainder of your annual payment will be refunded. This protects both sides: Nixlab cannot hold a build slot open indefinitely, and you never lose more than a single month's value for a service you never activated. See Section 6 for your responsibility for the accuracy of submitted information.

Buying out your site

At any time while your Launch subscription is active, you may purchase full ownership of your site and domain for a flat one-time fee of RM3,500. This transfers the site's code and the domain registration to you, ending your obligation to pay the RM497/month (or equivalent annual) Launch subscription fee. After buyout, you may continue with Nixlab's Maintain retainer for ongoing hosting, security, and support, or take the site fully independent.

Buying out your site is a separate transaction from cancelling your subscription, and is available regardless of how long you've been subscribed. However, if your domain was registered within the last 60 days, the domain-transfer portion of the buyout is delayed until the 60-day mark due to ICANN's inter-registrar transfer lock (see Section 3 below); your purchase is still accepted and the site ownership/code transfer proceeds immediately, only the domain hand-over is deferred.

This section applies to all Nixlab-hosted sites and domains where Nixlab registered or manages the domain on your behalf, regardless of tier. This includes Launch subscriptions by default, and any Starter/Business or retainer client whose domain Nixlab manages.

While your subscription or hosting arrangement is active, Nixlab retains ownership of the site and the associated domain. Ownership does not transfer to you automatically on cancellation. You are licensed to use the site for your business for as long as the arrangement remains active and in good standing. See below for how ownership transfer works.

Cancelling within 60 days of your first payment or domain registration

Due to ICANN's inter-registrar transfer lock, a newly registered domain cannot be transferred to another owner within 60 days of initial registration, regardless of Nixlab's own policy. If you cancel within this window, your site and domain will be shut down within 48 hours of cancellation. No ownership transfer is available during this period, as it is not technically possible.

Cancelling after 60 days

If you cancel after 60 days without having already bought out your site (see Section 2, Buying out your site), you may purchase full ownership transfer of your site and domain for the same one-time fee of RM3,500. This upgrades you to full, independent ownership. Nixlab will transfer the domain registration and hand over the site so it no longer depends on your Nixlab subscription.

If you decline the ownership transfer, or do not complete payment of the fee within 7 days of the invoice being issued, your site and domain will be shut down. Nixlab will provide at least 24 hours' advance notice before the shutdown takes effect.

No liability during the shutdown window

From the point Nixlab first notifies you that your site and/or domain is at risk of shutdown, whether the 48-hour notice under an immediate cancellation (above) or the 7-day invoice deadline and follow-up notice for an unpaid ownership transfer, you are responsible for taking any action required on your end within the notice period given. This includes paying the ownership transfer fee, backing up your content, or arranging migration. Nixlab is not liable for any financial loss, business interruption, lost revenue, or reputational or brand damage arising from the shutdown of your site or domain, whether during or after any notice period, except to the extent such loss results directly from Nixlab failing to provide the notice period stated above. You are solely responsible for ensuring any required transfer, backup, or migration is completed within the time given.

Your acknowledgment

For Launch subscribers, checking the consent box at checkout confirms that you have read and understood this section, and that you accept that cancelling, within 60 days or after, may result in your site and domain being shut down if an ownership transfer is not completed. This acknowledgment is required before your subscription and build begin. For Starter/Business or retainer clients whose domain Nixlab manages, this policy is additionally acknowledged in your signed Service Agreement or engagement confirmation.

Maintain, Grow, and Scale are recurring monthly retainers covering hosting/maintenance, automation, and support at increasing levels of scope. The specific inclusions, response-time commitments, and price for each retainer are described on the relevant service page at the time you subscribe, and form part of these Terms.

Retainers are billed monthly in advance and renew automatically. As with Launch, charges already billed are non-refundable, except where a specific guarantee is offered on a setup fee for Grow or Scale. In that case, the guarantee terms presented to you at signup govern that fee only, not the ongoing monthly retainer charge.

You may cancel a retainer at any time, effective at the end of the current billing period. Response-time commitments (e.g. 48-hour email support on Maintain, 24-hour priority support on Grow) are service targets, not guaranteed SLAs with financial penalties, unless otherwise stated in a signed agreement.

If your retainer includes a bundled domain or hosting arrangement managed by Nixlab, Section 3 (Cancellation, Domain, and Site Ownership) applies on cancellation.

Starter and Business are custom, project-based website builds. Because scope, timeline, and payment structure are negotiated per engagement, these builds are governed by a separate, signed Service Agreement provided to you at the proposal stage, not by a generic subscription flow.

That Service Agreement is the primary contract for your build and takes precedence over these Terms on any point where the two conflict. Where the Service Agreement is silent, these Terms apply, including Section 3 (if Nixlab manages your domain), Section 7 (Intellectual Property), Section 9 (Disclaimer of Warranties), Section 10 (Limitation of Liability), and Section 12 (Governing Law).

You are responsible for the accuracy of the business information, logo, and images you submit to Nixlab for any build. You warrant that you own or have the right to use any logo, image, or content you provide, and you agree to indemnify Nixlab against any claim arising from content you supplied.

For Launch, Nixlab is not responsible for delays caused by incomplete or late submission of your questionnaire or assets. The 7 business day build timeline runs from the point your submission is complete. For Starter/Business, timeline dependencies on client-provided content are set out in your Service Agreement.

Nixlab retains all rights to its own templates, code, and design system used to build your site. Content you provide (logo, images, business copy) remains yours. On completion of an ownership transfer under Section 3, or as otherwise specified in a Starter/Business Service Agreement, you receive the rights necessary to independently operate the transferred site and domain going forward.

Nixlab may suspend or terminate your subscription, retainer, or engagement for non-payment, breach of these Terms (or a signed Service Agreement), or misuse of the service, including unlawful or fraudulent content. Where reasonably possible, you will be notified before suspension.

Services are provided on an "as is" and "as available" basis. Nixlab does not guarantee specific business outcomes (such as lead volume, search ranking, or revenue) resulting from your website or automation, except where a specific guarantee is explicitly offered for a retainer setup fee. Nixlab will use reasonable skill and care in delivering the services described for your tier.

To the maximum extent permitted by Malaysian law, Nixlab's total liability arising out of or relating to these Terms or the services provided will not exceed the total amount you paid to Nixlab in the 3 months preceding the claim. Nixlab is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities. Where a Starter/Business Service Agreement specifies a different liability cap, that agreement governs.

Nixlab may update these Terms from time to time. Material changes will be notified to active subscribers by email at least 14 days before taking effect. The "Last updated" date at the top of this page reflects the current version.

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or your use of Nixlab's services will be subject to the exclusive jurisdiction of the courts of Malaysia.
